Website terms
A clear basis for using this website and starting a conversation.
At a glance
These terms cover the BearStack website. Any paid work begins with a separate written scope and agreement.
About these terms
This website is operated by Bearstack, at The Piano, Westlands, Nairobi, 00100, Kenya. These terms apply to your use of the BearStack website. BearStack describes website care, hosting, rescue, migration and growth services here. Please use the website lawfully and respect these terms. If you have a question, contact support@bearstack.ke.
Our Privacy policy explains how personal information is handled. Our Cookies policy explains browser storage and related requests.
Enquiries and service agreements
Sending an enquiry or reading a service description does not book work or create a paid service contract. We confirm the work we can take on through a written scope and agreement.
That agreement sets out deliverables, fees and currency, payment arrangements, access requirements, timelines, support, third-party costs, cancellation, refunds and any service commitments. These website terms do not set those commercial details or replace an existing client agreement.
Please do not provide passwords or sensitive information through the enquiry form. We will agree an appropriate way to exchange access details if they are needed.
Using the website responsibly
You must not use this website to send unlawful or abusive material, spam, malicious software or information you are not authorised to share. Do not attempt to gain unauthorised access, interfere with the website, bypass security or place unreasonable load on its systems.
You may browse the public website and link to its public pages. Automated access must respect applicable law and must not impair availability or bypass access controls. We may restrict access where reasonably necessary to protect the website or comply with law.
Website content and ownership
BearStack’s branding and original website material belong to BearStack or their respective rights holders. Third-party software, fonts, imagery and trademarks remain subject to their own licences and rights.
You may view and print website material for your own reference. Further reproduction, commercial reuse or use of BearStack branding requires permission unless an applicable licence or law allows it. Referencing a third-party platform does not imply endorsement or a formal partnership.
Descriptions, examples and availability
Service descriptions explain the type of work we offer; the agreed scope determines what is included in your engagement. Illustrative case studies, concepts and sample results are identified as such and do not represent verified client outcomes.
We aim to keep information useful and accurate, but it may change or contain errors. The website may be unavailable during maintenance, faults or events outside our control. Website descriptions do not guarantee uninterrupted availability, complete security, search rankings, sales, recovery results or a particular response time. Any specific commitment must be stated in your service agreement.
Third-party services and links
Linked websites and services are operated by their own providers. Their terms and privacy policies apply when you use them. Before purchasing a third-party product or giving a provider access to your systems, check its terms and suitability. A client agreement will identify third-party services included in any work we undertake.
Responsibility and legal rights
Use the website’s general information as a starting point and discuss your particular requirements with us before relying on it for a business decision. Responsibility for any paid work is addressed in the relevant service agreement and applicable law.
Nothing in these terms excludes or limits a right, remedy or liability that cannot lawfully be excluded or limited. These terms do not remove protections you may have under applicable consumer or data protection law.
Kenyan law and concerns
These website terms are governed by the laws of Kenya, subject to any mandatory protections that apply to you. Kenyan courts have jurisdiction subject to any mandatory right to bring a claim elsewhere.
If a concern arises, email support@bearstack.ke so we can try to resolve it. This does not prevent you from exercising a legal right or contacting a competent authority.
Changes to these terms
We may revise these website terms as the website changes. The revision date appears at the top. Revised terms apply to future use and do not change an existing service agreement unless the parties agree or the agreement permits it.
